I'm not from the US, so I'm mega confused... Why are they allowed to take this person after the case was dismissed?

[–] AA5B@lemmy.world 81 points 1 day ago (1 children)

Legally they’re not. That’s why they’re masked. That’s why the protests, the complaints, the articles about fascism. The current regime somehow holds themselves above the law, above the Constitution, above human rights. It a combination of a power grab by extremists in the executive branch, collusion from legislature and personal favors in the judicial. Sometimes it really looks like our entire national leadership should be in jail or worse.

It's also as a consequence of states that no longer share the same values. While I'm sure NY has its fair share of assholes working under ICE, how much do you want to bet most of that ICE staff has been brought from places like Texas? They are literally targeting states like NY and LA with military vehicles.

When will the US realize that people no longer hold the same values across state borders and that the only who will win out are the ones who exploit it? This isn't because of the people but because of control of the media and culture, like how Sinclair has been buying up local news stations selectively.

Then why is security not stopping them but stopping everyone else. Fucking hell.

Same reason why security didn't stop the Gestapo in Nazi Germany.

Widespread fear, caused by terrorism and threat of violence and being disappeared.

[–] thedruid@lemmy.world 10 points 22 hours ago

Yep. Every sniff of complaint gets met with an investigation threat. .

Fascism is currently in control

Because about 2/3 of the voting population supports this, directly or tacitly.

The curelty of the majority. What do you do when the democratic process results in let's say, enslaving a minority, genocide, or mass incarcerations and deportations? Can you go against the will of the population?

[–] AA5B@lemmy.world 10 points 1 day ago

While there are way too many who want this cruelty, I have more hope for humanity than that. I have to believe most are low information voters who’ve been manipulated.

I recently had a discussion with my conservative brother, where it was clear that we don’t even live in the same reality. He’s generally a compassionate person, willing to help anyone, but seems to have really bought the narrative. It’s not that he opposes higher education but clearly Harvard is violently antisemitism and the president needs to do something. It’s not that he opposes equal opportunity, but all those DEI hires are taking jobs from people like him. And yes, those deported are all violent criminals (like in my town where masked SS roughed up a city councillor trying to witness the mistreatment of his constituents)

If this is the same thing I'm thinking of, the case was to be allowed to immigrate in the US. It was dismissed, so they were no longer legally in the country.

It's rancid bullshit that they were instantly detained, of course, but** there is a logic to it.

How a normal courthouse arrest would work: Judge asks the court's deputy to take the person into custody and an officer walks up to the person at the podium and tells them they are going to put cuffs on them, tells them their rights, whatever. You have to go through metal detectors and security to enter a courthouse in the U.S. They clearly do not have a weapon on them or it would have been confiscated upon entry during that process. Some our local courthouse do not even allow you to bring your phone in. (This policy varies as the courthouse in the next down does allow you to). Anyways. This man clearly was not running, or fighting and had no weapon on him. So by all definitions he showed up to court as requested and complied with all requirements and was physically assaulted and taken to the ground for no reason.

We need to start putting these officers on trial for assault/battery charges. Note: if such was done here the victim would legally be allowed to stay in the U.S. and have an expedited citizenship case during the court proceedings.

Aka the law would essentially put those officers in jail and grant citizenship to the man who did what he was asked. The fact that it won't happen speaks volumes about how the executive branch is not upholding the legislative branches decisions. Therefore all executive branch members letting this occur should be charged with treason

With the way qualified immunity works these days, "Whoopsie, disappeared someone, my bad, I'm sowwy" Is a legitimate defense.

I'm skeptical. There are documented cases where ICE abducts people literally on their way to be sworn in as US citizens and deports them. Despite what they say, they don't care about people immigrating here legally, it's all about racism.
