Can trump just pardon him?

[–] RejZoR@lemmy.ml 15 points 2 weeks ago (2 children)

Probably. Current USA administration is an absolute corruption circus.

Cesspool, not circus. Don't slight the extraordinarily skilled circus artists.

Remember when they used to try to hide it?

That is what much of MAGA admire about him: that he is at least being up-front about it.

The stock market insider trading is something Democrats are guilty of too, I'm sure, but his manipulation via yoyo tariffs is probably seen by MAGA as him just doing it better.

And they would be laughing at how most of Liberal media seems to be oblivious to it, focusing instead on cheap laughs poking fun of how he can't make up his mind. Comedians like Maher, Colbert and Stewart are especially suckers on this issue.

Calling Maher a comedian is a bit of a stretch.

Well I find him funny but refuse to watch after his dinner with Trump.

Was getting tired anyhow of his fixation on pet topics: Millenials, Covid, wokeness, Gaza - it isn't about his stance (I can laugh at my own team) but it was kind of the same jokes being rehashed year after year and they were beginning to sound more like rants...

OK I see what you meant with your comment.

Haha yes, same attitude I have to the guy.

It does not appear to be a criminal case.

Ngl, I don’t really understand how pardons work.

The president can pardon anyone accused or convicted of federal crimes. This is a civil case, so it is not criminal, so can't be pardoned. Similarly governors have the same power but at the state level. The president cannot pardon state level crimes.

Even if he could, Musk would have to accept the pardon which involves admitting his guilt.

A pardon means punishment is waived. You have to be punished before a pardon applies, and you have to be found guilty before you can be punished. So the only way to avoid the trial is to plead guilty/no contest.

A pardon is not immunity, immunity means you cannot be tried so the question of guilt is forever left unanswered.

Can't be pardoned from a lawsuit. Just from crimes
