You can only legally take someone into custody if you have jurisdiction there. You could argue whether they do or do not have jurisdiction in the waters that Palastine claims but they were not even there, they were in international waters. That is kidnapping.

Russian rulers don't seem to care about the life of Russian civilians, so I'm really not surprised they also don't care for non-Russian civilians. Kudo's to HRW to make this story visual (making it more disturbing, but also more real (yes making this more real matters, because normal humans can't imagine something like this just happens because normal humans don't drop explosives on people walking to a bus stop for example)).
Only people who are against democracy say stuff like this.
In those cases someone will likely respond or edit the comment to show they didn't mean it in a bad way or something. Staying silent after making a point is more on point for someone who knew exactly what their comment will cause. You might be right, but I am not putting my money on that in this case.
